“2008 NAB AFL AUSKICK STATEMENT INSERT” PROMOTION
HOW TO ENTER
1. To be eligible to enter, individuals must personally receive a NAB AFL Auskick promotional flyer with their NAB bank statement.
2. Entrants must then enter online by visiting www.aflauskick.com.au, follow the prompts to the competition entry page, input the requested details including their full name, address, a valid email address (optional), phone number and the codeword displayed on the NAB AFL Auskick promotional flyer and submit the fully completed entry form during the promotional period.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to NAB account holders who are Australian residents and who personally receive a NAB AFL Auskick promotional flyer during the promotional period.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable or illegible entries will be deemed invalid. Unrecognised codewords will not be accepted.
6. Only one entry permitted per person.
7. Entrants must retain their original NAB AFL Auskick promotional flyer (clearly showing the codeword used to enter). Failure to produce the NAB AFL Auskick promotional flyer when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
9. Promotion commences 01/03/08. Entries close at 5pm AEDST on 31/03/08. The draw will take place at the Australian Football League, 140 Harbour Esplanade, Docklands VIC 3008 on 07/04/08 at 10am AEST.
10. Winners will be notified by mail and their names will be published in The Australian on 11/04/08.
11. The Promoter’s decision is final and no correspondence will be entered into.
12. The first five (5) valid and correct entries drawn will each win an adult AFL Silver Membership valued at $310 and a Sherrin Football signed by a NAB Auskick Ambassador valued at $150.
13. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
14. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
15. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. The AFL Silver Membership prizes are subject to the standard AFL membership terms and conditions and the conditions of entry of each various event venue.
17. Total prize pool value is up to $2,300.
18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
19. A draw for any unclaimed prizes may take place on 07/07/08 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 11/07/08.
20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
22. Any cost associated with accessing the AFL Auskick website is the entrant’s responsibility and is dependent on the Internet service provider used.
23. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any AFL match is cancelled or rescheduled for any reason; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
