AUSTRALIAN FOOTBALL LEAGUE “2008 NAB AFL AUSKICK GRAND FINAL” PROMOTION

HOW TO ENTER

Individuals who successfully register for the 2008 NAB AFL Auskick program and continue to be actively involved in the program (ie. Have participated throughout the season and paid full registration fees as at the closing date) will automatically receive one entry into this promotion.

TERMS AND CONDITIONS

1.    Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.    Entry is only open to Australian residents aged between five and twelve years. Immediate family members of the Promoter and agencies associated with this promotion are ineligible to enter.  Immediate family means any of the following: child or step-child (whether natural or by adoption), niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.    Only one entry permitted per person.

5.    Entrants must retain their NAB AFL Auskick registration receipt which is located at the foot of the NAB AFL Auskick registration form.  Entrants may also be asked to provide their Auskick membership number to confirm their eligibility to receive a prize, if they are drawn as a winner. Failure to produce the registration receipt and Auskick membership number when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize.

6.    Promotion commences 14/01/08. Entries close 5pm EST on 1/08/08. The draw will take place at the AFL, 140 Harbour Esplanade, Docklands, VIC, 3008 at 10am EST on 4/08/08.

7.    Winners will be notified by mail and the names of winners from NSW, VIC, ACT and SA will be published in The Australian on 8/08/08.  

8.    The Promoter’s decision is final and no correspondence will be entered into.

9.    The breakdown of development region is as follows: 15 in NSW/ACT, 19 in VIC, 8 in TAS, 18 in SA, 5 in NT, 12 in QLD and 17 in WA.  The first valid entry drawn from each development region will each be selected as a Provisional Winner of an AFL Toyota Grand Final Weekend prize.

10.    Each AFL Toyota Grand Final Weekend prize is for 1 adult and 1 child (12 years or under) and is valued at up to $4,401.18 for winners from NSW, ACT, SA, NT, WA, TAS, NT and is valued at up to $741.89 for winners from VIC.  For all winners the prize incudes:

  • General admission tickets for 1 adult and 1 child to the 2008 Toyota AFL Grand Final on 27/09/08;
  • Invitation for 1 adult and 1 child to a welcome dinner;
  • An invitation for the child to participate in the 2008 AFL Grand Final parade around Melbourne city (‘Parade’);
  • Involvement in pre-game activities;
  • An invitation to participate in the AFL Auskick grid games at half time of the AFL Toyota Grand Final;
  • Uniforms for the child to wear during the Parade and the pre-game activities;
  • A lunch pack including sandwiches and water valued at $10 daily each day for each of the winner and their companion;
  • A buffet dinner at a local restaurant, to be determined by the Promoter in its absolute discretion to the value of $25 for each winners and their companions on each of the following two nights; and
  • Chartered bus transfers between all locations on a chartered bus.


Winners from regions which are outside the Melbourne Metropolitan area will also receive 3 nights twin share four star accommodation at the Sebel/Citigate Hotel.

Winners from regions outside of Victoria will also receive return economy class airfares from the winner’s capital city to Melbourne for one adult and one child (12 years or under).  If the winner is from Victoria then the prize does not include airfares and the airfare component of the prize is not redeemable for cash.

Spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken on dates to be specified by the Promoter to coincide with the 2008 AFL Grand Final event and is subject to booking and flight availability.   All transportation outside of the competition timetable is the responsibility of each winner and their companion.  The promoter will not be responsible for any additional transportation costs incurred.

11.    In addition the winners will be given the opportunity to be 1 of 22 Auskick participants in the Grand Final Medal Presentation Ceremony.  The Promoter will give each winner the opportunity to submit a written submission as to why they love Auskick, in 25 words or less.  These submissions will be judged on creative and literary merit.

12.    Prizes will be awarded to the winner’s nominated parent or guardian.  It is a condition of accepting the prize that each child be accompanied by their parent or a suitable guardian on the trip.  During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner (and any companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in. Prize is subject to the standard terms and conditions of individual prize and service providers.

13.    If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.

14.    In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.

15.    Subject to the unclaimed prize draw clause, if for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

16.    If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

17.    The AFL Toyota Grand Final ticket prizes are subject to the event venue and ticket terms and conditions. The Promoter hereby expressly reserves the right to eject any winning child and their parent/guardian for any inappropriate behaviour, including but not limited to intoxication of the adult, whilst participating in any element of the prize.

18.    Total prize pool value is up to $66,062.70 in NSW/ACT, $14,095.91 in VIC, up to $35,233.44 in TAS, up to $79,275.24 in SA, up to $22,020.90 in NT, up to $52,850.16 in QLD and up to $74,871.06 in WA.

19.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

20.    In order to be eligible to take the prize, each entrant must be able to take it at the specified time. The Promoter will draw additional entries and record them in the order drawn as reserves. The following process will apply to the awarding of the AFL Toyota Grand Final Weekend prize (‘Event Prize’).

(A)    All States/Territories excluding SA: The Promoter will attempt to contact the Provisional Winners by phone on up to 5 occasions. Each provisional winner has until 10am EST on 12/08/08 (“Claim Date A”) to claim the Event Prize. If he/she is contacted prior to Claim Date A and is eligible he/she will receive the Event Prize. Otherwise, part (B) will apply.

(B)    The Promoter may select a Reserve and attempt to contact him/her by phone on up to 5 occasions within a 48 hour period, except if the Reserve is from SA, in which case part (C) will apply. If contacted and eligible, he/she will receive the Event Prize. If the Reserve cannot be contacted within 48 hours, or is contacted but ineligible, or cannot confirm eligibility within 24 hours; the Promoter will select the next Reserve, and the same process as in this part (B) will apply until 10am EST on 20/08/08 (“Claim Date B”). If the Event Prize is not awarded prior to Claim Date B, the process in part (D) will apply.

(C)    SA residents: The Promoter will attempt to contact each Provisional Winner or Reserve in SA by phone on up to 5 occasions. He/she has until 11am on 5/11/08 (“Claim Date C”) to claim the prize. If contacted prior to Claim Date B (see part (B) above), and is eligible, he/she will receive the Event Prize. If contacted but ineligible, or cannot confirm eligibility within 24 hours, then the Promoter will select another Reserve, in accordance with part (B). If contact is made after Claim Date B but prior to Claim Date C, and he/she is ineligible, a prize of equivalent value will be awarded via the process in part (D), or if he/she is eligible a prize of equivalent value as determined by the Promoter will be awarded. If the Event Prize is not awarded prior to Claim Date C, the process in part (D) will apply.

(D)    In order to award a prize, as determined by the Promoter but of equivalent value to the Event Prize, a draw may take place at the same time and place as the original draw on 6/11/08, subject to any directions from a regulatory authority. The draw will exclude any ineligible Provisional Winners or Reserves. Any winner will be notified by mail and their name will be published in The Australian on 15/11/08.

21.    Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

22.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

23.    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in the prize including attendance at events included as part of the prize.

24.    It is a condition of accepting the prize that winners be accompanied by their parent or legal guardian at all times; and that such parents or legal guardians may be required to sign a legal release in a form to be determined by the Promoter in its absolute discretion.

25.    The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
